Marbella is currently undergoing a historic transformation. Long celebrated as a premier Mediterranean destination, the city is purposefully shifting its broader focus toward legal certainty, sustainable luxury, and year-round living. To better understand this pivotal moment in the municipality’s evolution, our Managing Director, Smadar Kahana, recently met  with Mayor Ángeles Muñoz and brought forward all the pressing questions we regularly receive from our buyers, sellers, and international investors. The Mayor’s answers reveal a clear, modern vision for Marbella’s future, fiercely prioritizing quality over quantity.

Erasing Urban Uncertainty

For years, buyers, sellers, and developers in Marbella have had to navigate a high degree of urbanistic complexity. When Smadar asked Mayor Muñoz how the recent approval of the General Municipal Development Plan (PGOM) fundamentally simplifies the day-to-day bureaucracy at City Hall, the Mayor’s answer was confident and definitive:

“We have moved from a complex situation to a clear and orderly one,” she explained. “The new General Municipal Development Plan (PGOM), brought into line with the Andalusian Law on Territorial Sustainability (LISTA), will finally recognise the city as it actually is, and that changes everything. In practice, this means that anyone who approaches the City Council knows from the outset what they can do and how to go about it. The rules are defined, the uses are clear, and much of the uncertainty disappears.”

Decoding Marbella’s Urban Planning: The PGOM and POU Explained

Historically, Spanish municipalities relied on a single, complex document known as the PGOU to dictate all planning. Today, Marbella is pioneering a much simpler model by splitting this heavy bureaucracy into two distinct, highly specialized instruments: the PGOM and the POU. By utilizing both the PGOM and the POU in tandem, City Hall has successfully streamlined its management and cut through decades of red tape.

For property owners, developers, and international investors, this dual approach ensures that the rules of the game are crystal clear from the very beginning. Based on the legal framework of the LISTA law, these two instruments work together to guarantee both legal certainty and everyday efficiency:

PGOM (General Municipal Development Plan) POU (Specific Urban Plan)
Scope: Serves as the macro-level, general planning instrument for the entire municipality. Scope: Serves as the micro-level, specific planning instrument focused on existing urban areas.
Primary Focus: Dedicated entirely to structural planning. It outlines the city’s long-term growth model, environmental protection zones, and major infrastructure networks (like main roads and water systems). Primary Focus: Dedicated to detailed urban planning. It manages the “day-to-day” regulations, defining specific building heights, street-level zoning, plot boundaries, and exact property uses (residential vs. commercial).
Core Objective: Officially recognizes the reality of the city as it actually is today, establishing a stable, legal foundation and long-term vision for Marbella. Core Objective: Streamlines municipal management by setting the exact, technical rules required for quickly processing building licenses and executing local projects.
Hierarchy: Acts as the foundational framework. The PGOM sets the absolute boundaries that no other local plan can contradict. Hierarchy: Operates strictly within the boundaries set by the PGOM, translating its broad structural vision into actionable, daily guidelines for residents.

Achieving Legal “Shielding”

In the world of international real estate, legal certainty is the ultimate currency. Smadar directly addressed this, noting that our clients need absolute peace of mind. When Smadar asked if a property license in Marbella now offers the same level of long-term security and institutional prestige as a global capital like London or Madrid, Mayor Muñoz was exceptionally clear:

“Marbella has taken a decisive step forward in terms of legal certainty because, for the first time in decades, it has a clear, coherent and stable framework that is also aligned with current regional regulations,” the Mayor stated. “Today we can say that we are on a par with major international markets. That is what investors are looking for: clear rules, stability and certainty in their decisions. Therefore, rather than talking about ‘protection’ in absolute terms, we are talking about a scenario of maximum security within the Spanish urban planning context, positioning ourselves as a reliable and competitive destination in the long term.”

Urban Maturity and Sustainable Luxury

Rather than pushing for rapid expansion, Marbella is intentionally embracing a philosophy of “Urban Maturity”. We asked the Mayor how this specific policy sets the city apart from other Mediterranean hubs and ensures the Marbella brand remains a global benchmark for boutique luxury. In response, she drew a clear line regarding the city’s boundaries:

“We do not want to grow at any cost; we want to grow in the right way,” the Mayor replied. “We have learnt from the mistakes of other destinations and are committed to quality over quantity. This means improving and raising standards in established areas, rather than expanding uncontrollably. This strategy creates genuine exclusivity and protects the Marbella brand.” When asked how the city facilitates these high-caliber developments while protecting its natural heritage, Mayor Muñoz stated that the City Council provides legal certainty and administrative efficiency, but remains incredibly demanding. Top-tier firms must respect the environment through strict energy efficiency, careful landscape integration, and protection of the local microclimate. “There is a clear line: respect for the environment. We are talking about energy efficiency, integration into the landscape and protection of the microclimate. Because today, the true luxury is the environment, and that is what we are protecting.”

Building a Year-Round Future

Looking toward 2030, Marbella is rapidly evolving into a primary, year-round residence for global citizens. When asked what specific infrastructure projects she is prioritizing to bridge the gap between simply visiting Marbella and truly living here. She outlined three primary areas of focus:

  • Connectivity: The city is working to drastically improve mobility and links with surrounding areas. To achieve this, the administration is demanding significant transport improvements from central government authorities.
  • Public Spaces: There is a clear, ongoing commitment to creating a more liveable city featuring abundant green spaces and dedicated areas for socializing.
  • Digital Infrastructure: Recognizing the needs of modern professionals, the city views robust digital infrastructure as a key component in attracting international talent who wish to work remotely from Marbella.

As their conversation wrapped up, the Mayor’s ultimate aim of all these efforts is remarkably clear: Marbella is no longer just a holiday destination, but a secure, top-tier city where people can confidently build a life. By intentionally harmonizing economic development, social well-being, and strict environmental protection, the new planning framework actively elevates Marbella into a leading center of excellence. It is a long-term vision designed to transform the city from a seasonal retreat into a mature, year-round residential haven with an increasingly balanced offering. Ultimately, through unwavering legal security and a commitment to sustainable luxury, the administration is ensuring that Marbella remains not only highly attractive to international visitors, but profoundly pleasant and stable for its permanent residents.
